I pride myself on delivering a high level of service and to always meet expectations,
however it is important for us both to have clarity on how things work.
This proposal and agreement outlines who should do what and when, if something were
to go wrong.

There are no complicated legal terms or unreadable long passages.
Although the language is simple, the intentions are serious.

You are hiring By Lauren Barber trading as OhLaDeDah Ltd for a Full or Half Day of
photography.
EXPECTATIONS
You - You will complete Your Brief Pack, which will be emailed to you upon booking. Clearly
stating you objectives for what you would like from your imagery. You will then post your
items to my address (which will be given to you via email) one to two days prior to you
booked date.
Me - I will style your items to meet the requirements you have stated in Your Brief Pack.
By the best of my ability, I will ensure that I capture images which achieve your objectives.
EXTRAS
If during the session you wish to add further requests, an extra hourly fee of £25 maybe
applied. On completion and receipt of your Photography, you wish or changes to be made,
this fee will be applied and payment must be made before photography can take place.
COMPLAINTS
In the event that you, the client, is not satisfied with the By Lauren Barber product or
service, any complaints should be addressed in the first instance, and within 1 working
day of the delivery date, to hello@bylaurenbarber.com
CANCELLATION
There maybe an occasion where you need to cancel our session.
Should this be the case, the following cancellation fees apply.
Cancelling within 14 days of our session a 50% fee applies. Less than 14 days before session:
Full payment is retained.
Should you wish to move a session, you must inform me within seven working days of our
session. I will do my best to offer you an alternative date. However it may mean a
considerable time lapse if I have other booked clients.
Under very extraordinary circumstances, I have to cancel, I will contact you as soon as I
know I cannot complete your photography in the time we have allocated. Depending on
the circumstances, I will reschedule with you.
LEGAL
I will always deliver to the best of my ability but I am not liable to you or any third-party for
damages, including lost profits or lost savings. You send your items to me at your own risk,
I will not be liable for any accidental damages of these items and if you wish for me to
return items via insured post this will be an additional cost you need to make me aware of
prior to our working together.
Any liability is strictly limited to the price you paid for the session. Finally, if any provision of
this contract shall be unlawful, void, or for any reason unenforceable, then that provision
shall be deemed severable from this contract and shall not affect the validity and
enforceability of any remaining provisions.
COPYRIGHT AND IP
I’m sure you understand how important intellectual property and copyright are to a
creative entrepreneur. But to be clear, photos and images are intellectual property. As
such, photo ownership stays with the photographer. Booking a photo shoot, means we
enter a contractor relationship. Therefore the photographer (By Lauren Barber) will still be
the owner of the resulting photos. However, I grant you with an unlimited license for these
photos, but legal ownership stays with the myself.
I also hope you’ll want our working relationship to be a good one, so you agree to stick
firmly to our agreement and not repurpose, repackage or redistribute any of my work. If
you wish to share your images with a third party, you must request permission from
myself.
I love to share what I’ve created for my clients on my blog, social channels and in my
printed literature. I reserve the right to use the imagery I have created for you on each of
the platforms. If you would prefer me not to do this please let me know at the outset.
PAYMENTS
Payment is due in full upon booking to secure your slot. By checking out online or transferring the full amount, you
agree to be bound to these terms.
